1. Acceptance of Terms

By accessing or using Gif Party ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all users, including streamers and viewers who interact with the Gif Party extension on Twitch.

2. Description of Service

Gif Party is a Twitch extension that allows viewers to play GIFs on a streamer's broadcast in real-time. The Service enables:

  • Viewers to select and play GIFs from our library
  • Streamers to monetize their channel through bits donations
  • Customization of GIF playback settings and moderation controls
  • Integration with various streaming software

3. Account Registration

3.1 Twitch Authorization

To use Gif Party, you must authorize our application through your Twitch account. By doing so, you grant us permission to access certain information from your Twitch account as described in our Privacy Policy.

3.2 Account Responsibility

You are responsible for:

  • Maintaining the security of your Twitch account
  • All activities that occur under your account
  • Ensuring your account information is accurate
  • Notifying us of any unauthorized use

4. User Conduct

You agree NOT to use the Service to:

  • Upload, play, or share GIFs that are illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with other users' enjoyment of the Service
  • Engage in any activity that disrupts or burdens our infrastructure
  • Use automated systems or bots without authorization
  • Circumvent any content filtering or moderation features

5. Streamer Responsibilities

As a streamer using Gif Party, you acknowledge and agree that:

  • You are responsible for moderating content on your stream
  • You will use the moderation tools provided to filter inappropriate content
  • You comply with Twitch's Terms of Service and Community Guidelines
  • You are responsible for any content displayed through Gif Party on your stream
  • You will not use Gif Party to facilitate violations of Twitch's policies

6. Payments and Bits

6.1 Bits Transactions

GIF plays on streams may require viewers to use Twitch Bits. All Bits transactions are subject to:

  • Twitch's Terms of Service and payment policies
  • Our platform fee structure
  • The pricing set by individual streamers

6.2 Revenue Sharing

Streamers receive revenue from Bits donations according to Twitch's revenue sharing model. Gif Party may retain a platform fee from transactions to maintain and improve the Service.

6.3 Refunds

Due to the instant nature of GIF plays, Bits spent on the Service are generally non-refundable. Refund requests for technical issues should be directed to our support team.

7. Intellectual Property

7.1 Our Content

The Gif Party Service, including its design, features, and content (excluding user-submitted content and third-party GIFs), is owned by us and protected by intellectual property laws.

7.2 GIF Content

GIFs available through our Service may be sourced from third-party providers. We do not claim ownership of these GIFs. Users must comply with applicable copyright laws when using GIF content.

7.3 User Content

If you upload custom GIFs or content, you retain ownership but grant us a license to use, display, and distribute that content through our Service.

8. Disclaimers

8.1 Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee uninterrupted or error-free operation.

8.2 Content Disclaimer

We do not endorse or guarantee the accuracy, quality, or appropriateness of any GIF content. Users access content at their own risk.

8.3 Third-Party Services

Our Service integrates with Twitch and other third-party services. We are not responsible for the availability or functionality of these services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIF PARTY SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or goodwill
  • Damages resulting from unauthorized access to your account
  • Damages arising from third-party content or services
  • Any amount exceeding the fees paid by you in the preceding 12 months

10. Indemnification

You agree to indemnify and hold harmless Gif Party and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or share through the Service

11. Termination

11.1 By You

You may stop using the Service at any time by disconnecting Gif Party from your Twitch account.

11.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, including for violations of these Terms. We will attempt to provide notice when possible.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions that should survive termination will remain in effect.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting updated Terms and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Gif Party operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes will be resolved through binding arbitration, except where prohibited by law.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gif Party regarding the Service.
